These terms of service govern the relationship between Pacheliev Consulting EOOD and any business or sole trader that uses the Fakturcho web application at https://www.fakturcho.com to compose and issue commercial documents. By registering an account, the user accepts the terms in this document.

1. Service provider

The service is provided by Pacheliev Consulting EOOD, UIC 208697044, Sofia 1324, Lyulin district, bl. 715, entr. B, fl. 1, apt. 21, Bulgaria, a company registered under Bulgarian law.

2. What the service is

Fakturcho is a web application through which a business or sole trader established in the European Union composes and issues commercial documents — invoices, proformas, credit and debit notes, quotes and delivery notes — and downloads them as a PDF file, together with a structured e-invoice file where the document type and the issuer's country call for one.

The application prepares documents from the data the user enters and applies the VAT rules of the issuer's own country. It is not an accounting service and does not replace accounting or tax advice. It does not submit anything to any tax authority or e-invoicing platform on the user's behalf: e-invoice files are generated ready for the user to download and upload themselves, or to send over the Peppol network.

Each account represents a single issuer with its own list of clients, catalogue and numbering series.

3. Registration and account

Using the service requires registration with a valid email address, a password, and the country in which the issuer is established. The user is responsible for safeguarding their access credentials and for all actions taken through their account.

The service is intended for businesses and sole traders (B2B) issuing commercial documents in the course of their trade or profession. Where a natural person registers for purposes outside any trade or profession, the consumer-protection provisions referenced in this document and in the Refund Policy apply to them.

The user represents that the data entered for the issuer and for clients is accurate and that they are entitled to process it. The content of issued documents, and its correctness under the tax law that applies to the issuer, is the user's sole responsibility.

4. Prices and payment

Issuing each document costs 0.10 €, deducted from the account's credit balance the moment the document is assigned a number. Composing and saving drafts, clients and catalogue items is free.

Credit is topped up through one-off packs priced at 5 €, 10 € and 25 €. A subscription of 5, 10 or 25 € per month grants double that amount in credit every billing period. A subscription grants credit; it does not exempt any document from the 0.10 € issuance charge.

A new account receives a one-off credit of 1.00 € on registration.

Payments are processed by Pacheliev Consulting EOOD, UIC 208697044, Sofia 1324, Lyulin district, bl. 715, entr. B, fl. 1, apt. 21, Bulgaria through Revolut as the payment service provider. Prices are stated in euro. Pacheliev Consulting EOOD is not currently VAT-registered, so no VAT is added to these amounts; if that changes, the applicable rate will be shown before payment.

5. Credit

Credit is a prepaid value in euro cents that is used only to issue documents in the application. Credit has no expiry date and does not accrue interest.

Credit cannot be transferred between accounts and is not paid out in cash, except in the cases covered by the Refund Policy.

6. User obligations

The user is solely responsible for complying with the accounting, tax and invoicing legislation that applies to their business in their own country, including any obligation to submit, declare or report issued documents to their national tax authority or e-invoicing platform. Fakturcho prepares the document and, where applicable, the e-invoice file ready for that step; it does not perform the submission itself.

It is prohibited to use the service to issue documents with untrue content, to circumvent tax obligations, or to take actions that infringe the rights of third parties.

Attempts at automated load, intrusion, or disruption of the service's operation result in immediate termination of access.

7. Liability and availability

The service is provided as is. We make reasonable efforts to keep it available and accurate, but we do not guarantee uninterrupted or error-free operation.

The provider is not liable for the accuracy of data entered by the user, nor for the tax or accounting consequences, in any country, of documents issued through the application.

The provider's liability for proven damages is limited to the amount paid by the user over the preceding twelve months.

8. Termination

The user may stop using the service at any time by discontinuing access to their account and requesting its deletion at the email address given above.

The provider may terminate access in the event of a breach of these terms, notifying the user at their registered email address.

Issued documents remain the user's obligation under the accounting and tax legislation that applies to them, even after access is terminated.

9. Changes

These terms may be amended. The current version is always available at this address, with the date of the last update. Material changes are communicated to the registered email address no later than fourteen days before they take effect.

10. Governing law and jurisdiction

Bulgarian law governs these terms and any matter not covered here. For a business (B2B) user, a dispute is resolved by agreement and, failing that, by the competent court in Sofia, Bulgaria.

Where the user is a consumer within the meaning of applicable EU law, this choice of law does not deprive them of the mandatory consumer-protection provisions of the country in which they are habitually resident, and they may bring proceedings before the courts of that country or of Bulgaria. Every consumer may use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, or complain to the consumer protection authority of their own country — for a Bulgarian consumer, the Commission for Consumer Protection.
